GNR,im'sure glad you are alright.From the looks of your bike,this idiot drove right up on to your back tire! Guys(people)like this ALWAYS manage to get themselves buried,and it wont' be soon enough to suit me...generally speaking i am not a big "sue em'" kind of guy,in this case,find yourself the meanest lawyer you can find sue the crap out of him !!

After reading that.......how do you get charged with aggregated assault with a deadly weapon WITHOUT intent to kill? Thats like grand larceny bank robbery without the intent to commit a crime.

I see your point.

In Louisiana there has to be injuries on the person severe enough to have caused death if continued, but in Louisiana they wouldn't have called it aggravated assault. That is just a threat with a weapon. In Louisiana is would be classified as aggravated battery -- and then stepped up to attempted murder if the injuries were severe enough.

Florida may or may not have a different set of circumstances that are necessary.

Apparently, this guy was slick enough to stop short of taking it further.

Some states have "vehicular assault" at multiple levels. Regardless, He got charged with what he should have, and hopefully the judge throws the AMA charge in as well, along with a heft bond, or preferably NONE!

I hope this thread will serve as a wake up call to all riders out there. Even in WI we have those who believe motorcycles have to cede to cages and get PO'd when they feel we're taking up their road space (had this emphatically yelled at me once). When you add some libation to that attitude it goes bad in a second (still another story I experienced about 8 years ago). Texting, drinking and attitudes. Not real 2 wheel friendly out there. Our only immediate recourse is hone our skills and be aware we're still invisible to everyone until it's too late. Laws may be a way to exact retribution but tell that to the bikers family in ICU or at the funeral. While I don't advocate eye-for-an-eye I'll do what it takes to keep me out of harms way. GNR, thanks to your skills and a guardian angel, you're alive to warn others. Hope everything turns out for your best.

This guy came up with a lot of crap he tried to sell the deputies. Best on was that I didn't like his music so I was driving aggressively and that's why he hit me was to get me to stop. Seriously, how stupid can stupid get?



Amazing. He is absolutely clueless, he just told the officers, he hit you on purpose with his car. I didn't think 50mph, was being "aggressive" on a county road.

Glad you're OK and glad you kept the bike up.

Deliberately hitting a bike with a car, especially at road speed, is attempted murder in my book.

So glad he was apprehended! On another sad note, a Patriot Guard rider on his way to an event was killed in Palm Beach County this morning. He was struck from behind by a 22-year old girl at 3:00 this morning while driving up Interstate 95. Police think alcohol may have been a factor...
