Lifeguard, others might chime in here, but most states have an implied warranty when you purchase a veh through a dealer. As a direct result, the dealer should be willing to help you right now. Wait and that may not happen.
Check the paperwork you signed. There should be some standard form in there telling you about your rights in the purchase of a used vehicle. Just be glad you got it from a dealer. If you bought it from an individual, you'd be on your own completely.

wow thanks so much for the advice. I am going to check the:
Terminals and wiring to/from the battery to make sure of solid contact
Pull plugs and crank to see if they are filling/filled with gas and then work on carb
make sure that the gas is off when not using
Pump is not factory so it still may be an issue
Can't go ack to dealer as I purchased directly from owner, dealer was only holding on to it (friend of sales guy). I am sure owner did not know about this problem.
will let everyone know what is going on with this thing in the future.

Battery is good and is on a tender. I have several bikes and this is the new one in the stable but she still deserves a good tender once in a while.

OK I am pulling a 360 on the rest of these guys it sounds to me like no gas getting to carb then to much gas ''''tell me this go to your bike turn on key, you should hear a click! click !click !that the fuel pump pumping gas to carb,did you hear it if not no pump .You may ask me why I 'm getting to that I had pump go out on me it ran great then would not start then messed with carb, it ran great then next day nothing, pump was shot point is pump just did not quite working but hung on for a while, working on and off I am just thinking out loud here let it set in ,hope ya get it fixed lets us know

Nice try Huskerbob but it is getting gas. The clicking is there, I cant get it to actually turn over more than one time. It just strains and then nothing and then a series of rapid clicking form somewhere near the battery. When hooked to the car battery it just slowly, and I mean one every eight to ten seconds, turns over and then stops after the third or forth trun. So again I am thinking it is compression from over filled cylinders. Cold as a witches hind end right now so no go one the testing. will have to wait until this weekend when I cna get the heater in the garage fired up. Frustrating

Take the compression solenoid cover off and manually push it in as you crank the bike and see if it starts then.

Yeah did that and after pouring over the tech section onthe forum I am really suspicous ofthe battery cable issue. Seems like from eveything I am reading and what I am seeing on the bike it has to be the cable/battery/something electrical. I am changing the cables and the battery this weekend and I will bet that is it. Will let you guys know (personally I think the dealership "mechanic" was full of crap!)
