This case was so troublesome in many ways. The county sheriff didn't arrest the homeowner at the time of the shooting almost three years ago. It seemed a clear case of self defense. He said the intruder threatened him and only tried to retreat when he brandished his gun. He didn't know if his wife was home or not, or even dead in the house. The intruder made it to his girlfriend's car and died while trying to drive away. But he and the sheriff have also been friends for very long time. So the sheriff was accused of favoritism.

Almost two years after the shooting the county prosecutor, who is widely viewed around here as a liberal hack, hired an outside investigator. People said he was just looking for a shooting conviction. That investigator said the intruder was shot in the back while trying to climb out of a window. From what I've read this determination was totally based on forensic evidence and photographs. But it was enough for the prosecutor to bring charges.

After the mistrial there was word going around that if there was a retrial then folks would petition the county to fire the county prosecutor. He's been in that office for 15 years.

wish the yelling people would just look at history, why haven't other country's tried to invade us? because they knew most of the population had guns in their homes!

I am friends and an occasional co worker with the Sheriff of Choteau county. He has a good opinion of ole Leo Dutton.

Cant say I have heard of your County Atty, though.

I guess I would have a hard time feeling okay with an intruder in my house.

The time to shoot someone in your house is not when he has a gun pointed at you. Not a lot of criminals are going to relent to a pat down either.

How can you be certain he is unarmed? A person in a house can close distance quite fast if he has only a knife.

Heck, with all the MMA out there you cant be sure the SOB is not going to beat you to death for the hell of it.

I figure the dude gave his permission to get shot when he broke into your house to take your stuff, or do worse.

If someone is breaking into my home I will put the laser dot on him and give him the chance to turn around and leave. It might just be the case of some drunken idiot thinking he is pulling a prank and got the wrong house. However, if after I confront him and he still keeps moving forward or goes for a weapon then I will have no second thoughts about pumping lead into him. I will shoot to kill and refuse to become a victim to a liberal justice system or law firm trying to soak me in a civil suit. That SOB is going on my boat and dumped just like Dexter would take care of taking out the trash. No cops, no judge, no jury, no court. He will have earned his reward and God will judge him in the hereafter and I will have a clear conscience.

Leo's a good guy I think. Haven't heard anyone speak bad about him. I've had coffee with him a few times.

In Hewitt, a sub of WACKO, last year 3 illegals made the mistake of trying to break into a former Marine's house and were greated with 6 rounds of 357 through the door. No charges and Hewitt is one of those rich areas where if the LEO's don't give enough tickets then they take turns giving each other one! The three illegals were caught several months later and no longer reside in the state of Texas. And for those interested, open carry came into effect the first of this year and nobody has had a gun fight on main street at high noon yet.

Yep-no High Noon so far, and back when concealed carry was first allowed, one of the first shootings by a license holder was when a big, beefy Samoan was punching a much smaller guy through his driver's side window who was trapped in his own car, and they were stuck in traffic. The only real reason I was /am for the open carry is so that I no longer have to worry about being hasseled if my piece inadvertently shows.

History backs this up perfectly. The Japanese commander during Pearl Harbor told the Japanese War Council that it would be impossible to invade the USA since there would be a gun barrel poking out from every tree.

IIRC, that was Yamamoto, who lived in the U.S. for a number of years before Japan started the was in China.
